<p>According  to the calendar, today is the last day of session. And it would be,  too, if we had a budget. With the clock ticking down to zero, however,  it looks like we&#8217;re going into overtime.</p>
<p>We  will take up a few bills in conference today, but the budget towers  over every other consideration, and if we don&#8217;t finish today, we will be  back soon to get the job done. For now, I would like to use this last  day of session to talk about what&#8217;s in store for transportation this  year, and to share some great news out of session from Thursday.</p>
<p><strong>Victory on Clinic Safety</strong></p>
<p>Thursday  an unexpected victory when the Senate narrowly approved higher health  and safety standards for abortion clinics. And I do mean close: in his  capacity as President of the Senate, Lt. Governor Bill Bolling had to  break the 20-20 tie on the House amendments to <a href="http://r20.rs6.net/tn.jsp?llr=7ps5robab&amp;et=1104664115310&amp;s=18520&amp;e=001qb4dLO7QCI3jHtfbn8oXLbz8Ga_hrMdt5_f_PpQhn3hwjiFKyyY_GazMd0LoCQJKm05mEA0cSLHymNwKzuWXqtjdl94d6700hErmBpDArKqrR5_-m4YO1IPMjY3uoVwOkw5yTxv3QydEzbUNOrBMblJ72vma1HPg85S_xcCFWUygvLeABTKMTleg-A9ewPA2" target="_blank">SB 924</a>, which established the new standards.</p>
<p>The  debate yielded more heat than light, I&#8217;m afraid, with some Democrats  telling horror stories of a return to back-alley abortions and one  Senator repeatedly insisting that subjecting abortion clinics to similar  standards to those applied to other outpatient surgical clinics somehow  will violate women&#8217;s constitutional rights.</p>
<p>Of  course none of this is true. In debate, I explained that the U.S.  Supreme Court and the U.S. Court of Appeals for the Fourth Circuit (our  circuit) have both held that there is a legitimate state interest in  ensuring that abortion services &#8211; when they are provided &#8211; are offered  in a safe setting and that legislation nearly identical to that which we  passed is clearly constitutional.</p>
<p>Of course, everyone wants to know if this is a pro-life bill, and my answer is that it is &#8211; it&#8217;s about the life of the mother.</p>
<p>I&#8217;m pro-life, and unabashedly so, but frankly, this bill isn&#8217;t about abortion, at least not fundamentally. It&#8217;s not about <em>Roe v. Wade</em>,  or which abortion procedures are available at which stage of a  pregnancy, or who pays for them, or anything like that. All this says is  that clinics providing abortion services must be safe, that they should  be required to comply with the same regulations imposed on most other  outpatient surgical centers.</p>
<p>This  amendment shouldn&#8217;t divide us along party lines, or even along the  lines of the abortion debate. Unfortunately, over the years, some  abortion proponents have adopted the position that no change affecting  abortion, regardless of what it does, should be considered. In this  case, that rule of thumb is getting in the way of best medical  practices. Whereas standards have improved for other outpatient  procedures, old regulations remain in place for abortions &#8211; regulations  that do not adequately safeguard the life and health of the mother.</p>
<p>Do  I want to make abortions rarer? Absolutely! Was this bill about that?  No. It&#8217;s about making sure that common-sense health standards are in  place for the mother&#8217;s benefit &#8211; and not politically correct double  standards that endanger health and safety.</p>
<p><strong>The Transportation Agenda</strong></p>
<p>Last  year, the Secretary of Transportation oversaw an audit of the Virginia  Department of Transportation (VDOT) which revealed a shocking $1.4  billion in unspent funds &#8211; some of it in federal matching funds for  which we had not applied and some of it simply sitting, unused, in  dormant accounts. This while vital transportation projects were grinding  to a halt! As one of those calling for an audit, I was not surprised to  find waste and mismanagement, but the $1.4 billion figure surprised  even me.</p>
<p>This  year, Governor McDonnell resolved to address the issue head-on through  an ambitious transportation proposal and the creation of an innovative  new Virginia Transportation Infrastructure Bank.</p>
<p>Although  we currently suffer from a weak economy that has cut deeply into state  revenues, I firmly believe that the General Assembly must focus on  long-term solutions to the problems facing our Commonwealth&#8217;s transportation  system, and the Governor&#8217;s proposal begins to do just that, with $4.1  billion in bonding authority (about $1 billion of it preexisting) for  important transportation projects across the Commonwealth, as set forth  in <a href="http://r20.rs6.net/tn.jsp?llr=7ps5robab&amp;et=1104664115310&amp;s=18520&amp;e=001qb4dLO7QCI2ulEwT2mb4gWqB109nIzPv8hPTUAUI5eTWDarGhOaHHdyOnzCdMPHonzgVLXwdQ00S3lkpqmyOPF76LHMxib8gOKaDux_G3mE4217OvKjZqQHoSvOSKdMf6E5g9WSmfyba-HNwKh7HtjLFsYyU56ghEEuJLHXA5PsFKdFsTe_D_xdF5XsKytnk" target="_blank">SB 1446</a>.</p>
<p>The  funding will go to over 900 projects across Virginia, with 16 so-called  &#8220;infrastructure mega-projects&#8221; under consideration, including Route  495, I-95/395, and I-66 HOT Lanes; the Hampton Roads Third Crossing;  the stretch of I-64 between Richmond to Hampton Roads; the Norfolk /  Portsmouth Downtown / Midtown Tunnel; the Coalfields Expressway; and  improvements to state routes and interstates crisscrossing the  Commonwealth.</p>
<p>Details  remain to be discussed and debated, but no one can doubt the importance  of moving forward. Meanwhile, we&#8217;re starting to develop a Virginia  Transportation Infrastructure Bank to help direct funding for projects  large and small. It&#8217;s a sound concept that has, unfortunately, been  poorly explained and greatly misunderstood.</p>
<p>Currently,  state and local infrastructure projects are funded through Virginia&#8217;s  State Infrastructure Bank, bond issues approved by the General Assembly,  the resources of the Virginia Toll Facilities Revolving Account, and  the Federal Transportation Infrastructure and Innovation loan program.  These loans tend to have maturity dates of twenty to thirty years,  repaid through tolls, local taxes, or dedicated revenues.</p>
<p>When  your locality begins construction of a new road, they typically have no  choice but to borrow money, paying off the project over the course of a  few decades. And that&#8217;s not a problem, <em>per se</em> &#8211; if the project  was truly necessary, it should pay for itself over time. Unfortunately,  federal loans are significantly oversubscribed, the funding in  Virginia&#8217;s loan programs is limited, and the alternative, issuing  Private Activity Bonds, adds an interest rate of 7%, which is way too  high.</p>
<p>The  normal route, going through the federal loan program, has its own  disadvantages, as federal loans mean regulations and red tape, often  holding up projects and adding unnecessary cost overruns.</p>
<p>The  new Virginia Transportation Infrastructure Bank will cut through some  of the red tape by offering low-interest loans, issued on a competitive  basis, for state and local infrastructure projects. This is a huge step  forward from the far less rigorous budget process, or subjecting local  road projects to federal regulations and delays. The Infrastructure  Bank, meanwhile, will be capitalized solely with state funds and not  subject to federal regulations, with the Governor seeking funding from  year-end General Revenues, appropriations of the General Assembly, and  our dedicated transportation revenue streams.</p>
<p>So  that there is no confusion, we will not be raising any taxes or fees  create this infrastructure bank, and it is not a literal bank with an  actual building or staffed with bureaucrats. It is, rather, a sound  conservative an innovative way to prioritize transportation projects and  cut down on the cost of debt service.</p>
<p>There  remains, of course, much work to be done in streamlining and improving  the efficiency of transportation bureaucracy, and I will continue to  advocate for greater transparency and accountability on transportation,  to ensure that tax dollars are used responsibly and go toward our most  urgent infrastructure needs.</p>

<p>February 16, 2011 (Richmond, Virginia) – The Virginia Tea Party Federation, a coalition of 40 tea party/patriot/912 groups across the state of Virginia, is outraged by the actions of the Virginia Senate Finance Committee yesterday on HB 2314 – Income Tax Credit for Education.  Despite the pleas of parents and students, and the proven effectiveness of such programs in states like Florida, Senate Democrats ignored their constituents and voted in favor of the Virginia Education Association which threatened massive resistance should the measure pass out of committee.</p>
<p>“What is wrong with these people?” asks Mark Lloyd, Virginia Tea Party Federation Chair.  “This bill saves the state money, actually increases the money available for public schools, and gives low income<br />
kids a chance to break the cycle of poverty by giving them an opportunity for a better education than they may receive at their local schools.  Businesses love it, parents love it, and kids love it.  But the unions are terrified that their monopoly would be broken and Senate Democrats know who pays for their campaigns”.</p>
<p>Karen Miner Hurd, Executive Board Member of the Federation puts it this way, “This is incredible.  Louise Lucas (D-18, Portsmouth) and Yvonne Miller (D-5, Norfolk) represent areas with high numbers of low income kids that could really benefit from something like this.  One of the witnesses at the committee meeting, a teenaged girl, actually cried during her testimony about how much this being able to go to a private school from an at-risk school changed her life.  It’s appalling how these two Senators could disregard the needs of their constituents over the demands of the teacher’s union.”</p>
<p>The Virginia Tea Party Federation supports school choice for parents and children.</p>

February 15, 2011 (Richmond, Virginia) –</p>
<p>Despite the attempts of some  Senate Democrats, and special interest groups, HJ 693 (Constitutional  amendment; taking or damaging of private property for public use) was  saved and voted out of the Senate Privileges and Elections Committee  today.</p>
<p>The Virginia Tea Party Patriot Federation is in support of this  amendment which would protect private property from eminent domain  abuse.   <em>“The Kelo Decision of the Supreme Court in 2005 was a complete  reversal of the Founder’s intent on private property, “</em> says, Mark Kevin  Lloyd, Chairman of the Virginia Tea Party Patriot Federation. <em> “ Kelo  VS City of New London,  essentially said that property belonged to  whomever the government assigned it.  HJ 693 will secure constitutional  private property rights in Virginia.  We thank all of the Senators who  voted it out of committee, especially Senator Creigh Deeds (D- 25, Bath )  and Senator Phil Puckett (D- 38, Tazewell).</em>&#8221;</p>
<p>HJ693 proceeds to the full  Senate floor for a vote on February 16.  The Virginia Tea Party Patriot  Federation is asking Senators to vote in favor of the full bill without  any amendments.</p>
<p>HJ693 is co-patroned by Del Johnny Joannou (D-79,  Portsmouth).</p>

<p>In the latest communication from the LT Governor Bill Bolling, we are exposed to the insanity that reigns in Richmond, VA among so many of our so called representatives. </p>
<p><a href="http://virginiateapartypatriots.com/wp-content/uploads/2011/02/StopsignInPothole3.jpg"><img src="http://virginiateapartypatriots.com/wp-content/uploads/2011/02/StopsignInPothole3-300x225.jpg" alt="" title="StopsignInPothole3" width="300" height="225" class="alignleft size-medium wp-image-2488" /></a>The machine is moving full speed ahead to get this absurd transportation package rushed through.  <strong>The fools that have been elected seem to think we are stupid. </strong>That we don&#8217;t notice the revolving sales pitch that hits us every legislative session. <em>&#8221; The Sky is falling, If you don&#8217;t support this bill the end of the world will be upon us&#8221;.</em></p>
<p>Every year we are told of the &#8220;Crisis&#8221; that awaits us if we don&#8217;t pass X,Y or Z bill. When X,Y, and Z all = $$$. Money we don&#8217;t have. Money they want to take from us&#8230;those of us that pay taxes at least. Money that flows mostly <strong>into</strong> the northern part of the state. Money that is either borrowed, begged or stolen from the taxpayers.</p>
<blockquote><p>In the near term, <strong>infrastructure investment</strong> is the quickest, most effective action we can take to restart manufacturing. By working with <span style="text-decoration: underline;"><em>our partners at the federal level</em></span>, we can <strong>invest</strong> in critical <strong>infrastructure </strong>by passing a federal highway bill that is <strong>responsibly funded</strong>, and we can <strong>do the same at the state level</strong>.</p></blockquote>
<p>Funny&#8230;just a few days ago at the State of the Union we were told that we needed to &#8220;Invest&#8221;.  It was code for SPEND. It was a LIE and even after a historic election defeat against big spenders, nothing has changed. Americans are still overwhelmingly saying NO! Politicians are still overwhelmingly ignoring the will of the voters. Further, since when is anything that is done &#8220;for the public benefit&#8221; ever &#8220;responsibly funded&#8221;?</p>
<p>Here is another gem:</p>
<blockquote><p><strong>Infrastructure investment is a proven economic engine with lasting results.</strong> Not only does it drive growth, it creates lasting benefits. The U.S. Department of Transportation reports that 30,000 jobs are created for every $1 billion spent on highway infrastructure, yet <strong><em>we are spending less than 40 percent of what is needed to upgrade</em></strong> our surface transportation system nationwide. In fact, only 3 percent of the U.S. stimulus package was dedicated to rebuilding highways, roads and bridges.</p></blockquote>
<p>$1 Billion devided by 30,000 jobs = $<strong><strong> $33,333 per job </strong></strong>Not a very good return on investment.</p>
<p>I&#8217;d really like to see someone research where the money went. Where did all the BILLIONS of dollars that were allocated for repair and maintenance go? New Vehicles? Bonuses? Unions? Welfare freeloaders?</p>
<p>For the last 10 years we&#8217;ve grown the size of government in VA and in D.C.<br />
Maybe instead of squandering the money on every idiot pet project they can think of it should have been spent on the roads.</p>
<p>Anyone that has driven in Northern Virginia can attest to the fact that the money hasn&#8217;t gone into the roads. Unless you count the Asphalt patch jobs on Cement&#8230;Genius. I never took materials classes in college but even I know that those 2 materials do not go together.</p>
<blockquote><p>By <strong>fast-tracking</strong> new construction projects, we can <strong>inject economic activity</strong> and create jobs in the building industry. <em>Investing in infrastructure</em> drives job growth, productivity and competitiveness in manufacturing. That&#8217;s why I am supporting efforts like &#8220;I Make America&#8221; (<a href="http://www.imakeamerica.com/" target="_blank">www.IMakeAmerica.com</a>) &#8211; a campaign by equipment manufacturers to urge Congress and the White House to work together to pass a federal highway bill.</p></blockquote>
<p>Sounds like more of the same liberal crap that has gotten us into the mess we are already in. A mess of $14,000,000,000,000 of nationl debt. A mess of billions of dollars in state debt. A mess that we <strong>can not pay back</strong>. A mess that equates to over $125,000 for every taxpayer in America.</p>
<p>Notice also how we need to &#8220;fast track&#8221; these projects. Is that so we won&#8217;t feel the knife sticking into the back of John Q Taxpayer who thought he was voting for fiscally conservative representation?</p>
<blockquote><p>For years, Virginia&#8217;s leaders have talked about building a transportation system for the 21st century, but little has been done. We must improve our transportation infrastructure so our system of roads, rail and bridges can support the needs of Virginia businesses and residents.</p></blockquote>
<p><strong>That is because &#8220;for years&#8221; Virginia&#8217;s &#8220;leaders&#8221; have been robbing Peter to pay Paul. In the private sector we call that &#8220;embezzlement&#8221;. Politicians call it &#8220;fast tracking&#8221; and &#8220;investment&#8221;.</strong></p>
<blockquote><p>This year, Gov. McDonnell has <strong>proposed an aggressive transportation plan</strong> that is designed to ease congestion and shorten commutes for working Virginians &#8211; and allow state businesses to take advantage of the economic opportunities afforded by a <strong>state-of-the-art transportation system</strong>.</p></blockquote>
<p>The Tea Party on Lobby Day was given an audience with the Governor. We do appreciate that. However, it was not really the Q and A session we were expecting, it was instead a sales meeting that is so common with the big spenders in Richmond and D.C. </p>
<p>They were hoping that we would be uninformed and ignorant. They were wrong. <strong>We are a lot more politically and economically savvy than they realize. </strong>Governor McDonnell&#8217;s <em>&#8220;aggressive transportation plan&#8221;</em> is nothing more than smoke and mirrors. It&#8217;s full of all this talk of the &#8220;state of the art transportation system&#8221; but once again will not deliver. It&#8217;s no different than the previous 10 years of stupid plans that have failed us. <strong>Only this one further enslaves us with more debt we can ill afford.</strong></p>
<blockquote><p>Now is the best time in modern history for Virginia to get this done&#8230;The time to act is now.</p></blockquote>
<p>As opposed to the last 10 years? The Voters realize that much of the problems were started because of the theft by Democrat Governors and Legislators. That doesn&#8217;t justify a continuation of this practice.</p>
<p>I have an idea. How about they cancel the Metro Extension that is costing us $7 Billion dollars <a href="http://voices.washingtonpost.com/local-breaking-news/traffic-and-transportation/metro-dulles-extension-to-cost.html">( $3.83 Billion for Phase 2 + $2.76 Billion for Phase 1 = $6.59 Billion )</a> and use that money to pay for the &#8220;needed repairs&#8221; and &#8220;infrastructure investment&#8221;.</p>
<p>I&#8217;ve yet to meet one person that honestly believes that Richmond politicians will &#8220;fix the roads&#8221;.</p>

<p>Getting our economy moving again and creating jobs are the most important issues currently facing state government. Gov. Bob McDonnell has made me the point person in his administration for creating jobs, and my No. 1 priority is to make Virginia the best state in the nation in which to do business.</p>
<p>While we are targeting a number of strategic economic sectors as a part of our overall job-creation efforts, we want to make certain that Virginia continues to attract quality manufacturing companies. We need to be a state that makes things, not just a state that consumes things.</p>
<p>Virginia has a long tradition of supporting a thriving manufacturing industry. However, during the past decade, the manufacturing sector in America has shed 5.5 million jobs. Here, in the Old Dominion, our once thriving manufacturing sector has fallen on especially hard times.</p>
<p>Unemployment in manufacturing remains high, and our state trails only Ohio, Michigan and South Carolina in the number of manufacturing jobs lost in the past decade. We should be focusing our efforts on the re-establishment of these jobs with smart, pro-growth policies.</p>
<p>In the long term, we will reinvigorate manufacturing by taking a comprehensive approach. We intend to improve the tax and regulatory climate in our state so that we can better compete nationally and globally.</p>
<p>We also want to improve educational opportunities so businesses know that a skilled and educated work force awaits them if they invest in Virginia. And we want to provide the incentives that attract high-quality, advanced manufacturing business to the state.</p>
<p>In the near term, infrastructure investment is the quickest, most effective action we can take to restart manufacturing. By working with our partners at the federal level, we can invest in critical infrastructure by passing a federal highway bill that is responsibly funded, and we can do the same at the state level.</p>
<p>Infrastructure investment is a proven economic engine with lasting results. Not only does it drive growth, it creates lasting benefits. The U.S. Department of Transportation reports that 30,000 jobs are created for every $1 billion spent on highway infrastructure, yet we are spending less than 40 percent of what is needed to upgrade our surface transportation system nationwide. In fact, only 3 percent of the U.S. stimulus package was dedicated to rebuilding highways, roads and bridges.</p>
<p>By fast-tracking new construction projects, we can inject economic activity and create jobs in the building industry. Investing in infrastructure drives job growth, productivity and competitiveness in manufacturing. That&#8217;s why I am supporting efforts like &#8220;I Make America&#8221; (<a href="http://www.imakeamerica.com/" target="_blank">www.IMakeAmerica.com</a>) &#8211; a campaign by equipment manufacturers to urge Congress and the White House to work together to pass a federal highway bill.</p>
<p>For years, Virginia&#8217;s leaders have talked about building a transportation system for the 21st century, but little has been done. We must improve our transportation infrastructure so our system of roads, rail and bridges can support the needs of Virginia businesses and residents.</p>
<p>This year, Gov. McDonnell has proposed an aggressive transportation plan that is designed to ease congestion and shorten commutes for working Virginians &#8211; and allow state businesses to take advantage of the economic opportunities afforded by a state-of-the-art transportation system.</p>
<p>Now is the best time in modern history for Virginia to get this done. Construction costs have fallen, interest rates are at historic lows and our residents need the good jobs that will come with infrastructure projects. The time to act is now.</p>
<p>Virginians need policies that will help them create jobs. Additional investment in transportation and infrastructure is essential to a healthy, growing economy. We must take these actions if we hope to put our families, friends and neighbors back to work.</p></blockquote>

<p><strong>VTPP Statement Opposing Mandated Insurance Coverage In Virginia</strong></p>
<p>February  1, 2011 &#8211; RICHMOND – Today, the Virginia House of Delegates debated  HB2467.  This bill would impose mandated coverage for autism spectrum  disorder on insurance plans for most businesses across Virginia.   The  bill passed its second reading by voice vote on Tuesday afternoon.</p>
<p>Mark Kevin Lloyd, Chairman of the Virginia Tea Party Patriots Federation, released the following statement:</p>
<p>“This  is a misguided attempt by Speaker William Howell and a majority of his  colleagues in the House of Delegates use government as a tool for  compassion.  By doing so they ignore  the will of the people and, in particular, the Tea Party by anonymously  voting in support of more big government mandates. It appears they are  turning a deaf ear to citizens of the Commonwealth after the  overwhelming rejection of health care mandates in the form of ObamaCare.</p>
<p>If  passed, HB2467 does nothing to stop a full-on expansion of this  coverage, as well as any other mandated coverage the state sees fit, in  the near future.  This creates a slippery slope to a nanny-state type of  government, eroding away the freedom of choice and autonomy that  businesses and individuals enjoy today.</p>
<p>As  a conservative and a patriot interested in limited government, I am  opposed to this type of government intrusion into the daily personal and  business decisions of all Virginians.”</p>
<p>Autism is certainly a heartbreaking condition and the treatments are a terrible financial strain for many families.  <em>The concern of the Virginia Tea Party Patriot Federation with this bill is the inappropriate use of government.</em> There is nothing stopping individual insurance companies from adding  this coverage themselves as part of free market competition.  Virginia,  and our nation, has a history of private individuals and groups  assisting those who are in unfortunate circumstances.  Government is not  an arm of compassion, and no matter how well intended, can never  replace faith-based and private initiatives.</p>
<p>In  2010, the Virginia Tea Party Patriot Federation played a significant  role in securing the passage of the Health Care Freedom Act which made  it illegal to mandate individuals to purchase health insurance.</p>

<p>Richmond, Va. – The Virginia Tea Party Patriot Federation endorses Governor Bob McDonnell’s effort to privatize the 76-year-old state-run monopoly on the sale of distilled spirits. Legislation to privatize both retail sales and wholesales of a legal product out of the hands of state government has been introduced by Senator Mark Obenshain (R-Harrisonburg).</p>
<p>This practical piece of legislation will allow the Department of Alcohol Beverage Control (ABC) to focus on the core function of enforcing liquor laws and preventing sales of alcohol and tobacco to minors. The Federation supports Senator Obenshain’s proposal to privatize both the wholesale and retail components of ABC where free markets and competition can truly thrive. The legislation advanced by the Governor gets the state out of a business it never should have been in in the first place.</p>
<p>“Currently, ABC is in a conflicted position as a state agency that both regulates and competes with privately owned businesses across the Commonwealth,” said Mark Lloyd, Chairman-Virginia Tea Party Patriots Federation. “It must be nice to have that competitive advantage in the marketplace. This policy will lead to more private sector jobs and higher revenues for the state government.”</p>
<p>The Federation will be contacting legislators to encourage their support of SB 1272 and we will monitor their votes on this important initiative that demonstrates a commitment to the free market and smaller government. A vote for ABC privatization is a vote for focusing government on its core functions and bringing conservative principles back to Richmond.</p>

As  a states’ rights, pro-business republican since my youth(I registered  as a republican before I registered for the draft) I have always held a  certain distrust of the Federal Government and felt that state and local  government because of it is so much closer to the people was both more  effective and less corrupt. Growing up in an upper middle class,  conservative family of doctors, bankers, insurance agency owners and  small business people I was taught a certain respect and reverence for  the business class, its principles and efficiency.<br />
Recent  goings on in the Virginia House of Delegates and the Governor’s Office  have served to undermine both of these articles of faith and I find the  new reality of modern state government and business ethics a bitter pill  to swallow.<br />
This  week we saw how vested financial special interests have created an  obscene and incestuous relationship with the leadership in the state  legislature and the Governor’s office. This cabal managed to kill off a  bill (HB-1506) proposed by Delegate Bob Marshall that was designed to  protect the integrity of the county property records and preserve the  integrity of home owner’s title to their property. Simultaneously the  cabal attempted to alter the Uniform Commercial Code (UCC) with HB-1718,  proposed by Delegate Merricks, such that any “record” ( the previous  version said document) signed or unsigned by a person they claim owed a  debt would be good enough for the banks to win a legal judgment against a  person. In other words a spreadsheet from a bank would be good enough  to take someone’s home or report someone to a credit bureau. This was in  direct response to a Supreme Judicial Court case in MA where the court  said that a bank had to have proof it owned a mortgage before it could  foreclose on a home. Apparently it is not a novel idea in MA that a bank  should demonstrate that it has a legal claim to a mortgage before it  forecloses.<br />
The  problem that HB-1506 attempted to address originated in 1995 when big  Wall Street banks decided that they had the authority to replace the  existing public land title recordation system with its nearly 400 years  of successful history in Virginia, with a private system that only  members who pay in excess of $7,000 could access. This system called the  Mortgage Electronic Registration System (MERS) gutted the public  property records and left millions of homes with questionable titles.  The banks did this without any government approval and against the  recommendations of the title industry and the county recorders. They did  however get an opinion from Moody’s Rating agency the same people who  brought you AAA ratings on subprime loans. MERS has been found by 10  state supreme courts to be acting illegally and is currently being sued  by CA, NV, TN and 14 other states. The Federal Reserve, Office of the  Comptroller of the Currency (OCC) which regulates all the national banks  and the FDIC are investigating MERS for questionable business practices  and for the risk it poses to the financial system that may require  another bailout. The CEO resigned last week. Speculation in Washington  has the OCC taking over MERS and nationalizing our land records a clear  violation of states’ rights. All this so the banks could save $21 in  recording fees on deals worth hundreds of thousands of dollars.<br />
HB-1718  was submitted by Delegate Merricks. Bills to change the UCC are rare.  They are rare because the implications of unintended consequences are  usually substantial and not usually easy to foresee. The summary of the  bill on the Legislative Information System (LIS) states that the bill is  intended to address recent court decisions and changes in technology.  There is no question that the bill was targeted at both protecting MERS  and avoiding a court decision in VA similar to that in MA. Apparently  Delegate Merricks, member of a bank board and a former vice president of  a bank, thinks that banks should take the home first and then figure  out who actually is entitled to do so later. Never mind the risk to  title that a future buyer of a foreclosed home faces or that we have  situations in VA where multiple banks are foreclosing at the same time  on the same person. In that fight the winner gets the house and the  loser the right to sue the borrower for the loan amount.<br />
The  banks wanted HB-1506 killed and HB-1718 passed to protect MERS and, I  believe, to avoid providing proof to mortgage investors that they were  defrauded. The requirement to record would have provided evidence to  investors in mortgage backed securities (MBS) that what they bought was  empty; the mortgages were never legally transferred to the MBS. In my  humble opinion if you sell someone a security that you claim is backed  by collateral when it is not then that would be securities fraud.  But  then I am just an ignorant layman and not a master of the universe Wall  Street banker. Among these investors are Fannie Mae and Freddie Mac  whose losses are being paid for with your tax dollars to the tune of  $280+ billion dollars over the next three years. Other investors include  state and private pension funds. The total exposure to the banks  exceeds 1.5 Trillion dollars. You can see why they would fight so hard  and spend so much money to avoid a $21 fee and the right to use their  own “records”.<br />
HB-1506  was killed by the Speaker of the house (Delegate Howell), the Chairman  of the Courts Committee (Delegate Albo), the Chairman of the Civil  Subcommittee (Delegate Athey) and the governor’s office.<br />
Delegate  Howell, the Speaker, sits on the board of Virginia Heartland Bank.  Courts Chairman Albo received 13% of his campaign funds from the VA  Bankers Association and more from two major bank servicers. The lobbyist  representing the bankers, Matt Bruning, at the hearing of the Civil  Subcommittee was a former aid to the chairman of the subcommittee,  Delegate Athey, and an aid to the governor.<br />
One  of the reasons given by Delegate Athey for not passing HB-1506 on was  that the governor’s office in the person of Terri Suit, a former bank  lobbyist and current head of the governor’s foreclosure task force sent a  letter asking the subcommittee to hold off and let the task force work  on it first. Did I mention that according to the Virginia Public Access  Project that Terri Suit, who chairs the Foreclosure Task Force,  previously, was a paid lobbyist for the Mortgage Lenders Association and  the “private” members of the Task Force are almost entirely comprised  of representatives of the mortgage industry?</p>
<p>HB-1718  was pulled from the floor when Delegate Marshall threatened to attach  an amendment that would exclude mortgages from the language. Had the  speaker left it on the floor, the members would have had to record a  vote on the amendment and with the amendment there no longer was reason  to pass it. The bill is still alive waiting for no one to be watching.   Delegate Merricks sits on the board of Virginia Bank &amp; Trust and  has 25 years in the banking industry.<br />
I  spoke to the U.S. Attorney’s office in Richmond and to the FBI today  about all this. Although both declined to say they would not investigate  both indicated that this was politics as usual and may not rise to the  level of criminal corruption.<br />
I  do not know if the behaviors here rise to the level of criminal  corruption or not but they certainly meet my personal definition. At the  least the relationships are so inappropriate as to cause any reasonable  citizen to question the integrity of the process.<br />
A  survey released today in the Financial Times shows that Americans trust  of all large institutions from government to corporations is at an all  time low. Banks come in for particular levels of distrust with only 25%  of American saying that they trust financial institutions.<br />
A survey published last week ranked Virginia as the country’s second most corrupt state only after Tennessee.<br />
The  American people and citizens of Virginia have a right to feel as they  do after the shenanigans going on in Richmond this week.<br />
You  can take action: Call your delegate and tell them you want HB-1506  reheard and voted on by the full house. Call the governor’s office and  Terri Suit’s office.<br />
If you feel strongly enough, call the FBI &amp; US Attorney in Richmond.</p>

<p>The year has gotten off to a very busy start!!!!</p>
<p>Patriots  from all over VA came out for lobby day on Monday, January 17&#8211;it was a  great event&#8211;an opportunity to meet with legislators, enjoy the  fellowship of like-minded folks and network with old and new friends.  Hampton Roads was well represented.</p>
<p>I&#8217;d like to share some thoughts with you on a pressing issue.</p>
<p>The VA Repeal Amendment: <a href="http://www.repealamendment.org/" target="_blank">www.repealamendment.org</a> (not to be confused with repealing Obamacare)<br />
&#8220;Any provision of law or regulation of the United States may be  repealed by the several states, and such repeal shall be effective when  the legislatures of two-thirds of the several states approve resolutions  for this purpose that particularly describe the same provision or  provisions of law or regulation to be repealed.&#8221;</p>
<p>If you  are in support of the Repeal Amendment, please contact your state  senator and delegate and representatives outside your district and ask  them to support it now. It has been tabled for now. If there are enough  active voices in support of it, it can be revived.</p>
<p>The  Repeal Amendment, designed to protect the rights of individuals and  states rights from an overreaching federal government was carefully  crafted by experienced and dedicated policy-minded citizens in the hope  that other states would adopt a similar measure and taxpayers would be  able to exercise their constitutional rights through their state  legislators, when representatives at the federal level ignore the  Constitution and will of the people. To date, the reps on the Hill have  proven this measure to be necessary&#8211;a necessity to safeguard checks and  balances and restore limited government.</p>
<p>The Repeal  Amendment has come under attack by many on both sides. The left has  implied that states in support of such legislative action are advocating  succession. Some conservatives fear a Constitutional Convention would  take place and the wrong people would have the opportunity to usurp our  most beautiful document. Others believe this is a sound provision for  protecting the very God-given freedoms our founders asserted in our  framing documents.</p>
<p>One sure fact surrounding the Repeal  Amendment is that politics always plays a part in policy making. Like  many of you, I got involved in the Tea Party / Patriot movement because I  understand that all policy touches every aspect of my life, but I don&#8217;t  like politics. The Tea Party / Patriot movement thus far has offered  America a platform of sound policy, making issues front and center and  paying little or no attention to personal politics. The Repeal Amendment  does not follow this example. Finger pointing among and between Tea  Party / Patriot folks, conservatives, republicans, and independents (all  on the opposite side of the left) over this issue has been prolific.</p>
<p>The  Virginia Tea Party Patriot Federation comprised of 43 Tea Party /  Patriot groups offered support for the Repeal Amendment early on after  most of the member groups&#8217; leadership agreed to offer support. This was  not done in haste or without thoughtful consideration. Several Tea Party  / Patriot groups and their members in VA are actively opposed to this  legislative action and are loudly voicing their opinion. I am thankful  we have the freedom to speak our mind. My hope is that any support or  any opposition for the Repeal Amendment is not politically motivated.</p>
<p>To  truly accomplish our united goals and make an impact with integrity, we  must strive to place principle and policy above personal politics.</p>
<p>If  you are in support of the Repeal Amendment, please contact your state  senator and delegate and representatives outside your district and ask  them to support it now. It has been tabled for now. If there are enough  active voices in support of it, it can be revived.</p>
<p>The Tea  Party / Patriot movement has had many victories because we have been  unified on many issues. I hope we can find unity in our effort to put  forth and pass legislation that limits what the federal government can  impose on the states and the taxpayers who fund them.</p>
