Why This Is Important

We, the undersigned Americans, urge the Supreme Court to find the Obamacare individual mandate unconstitutional and strike down the law.

Ours is supposed to be a system of limited government that protects individual freedom. The individual mandate, if allowed to stand, would completely subvert our founding principles. Upholding the mandate would result in a government with no limits on its power that, far from protecting freedom, will extinguish it and can commandeer the population time and again on even the flimsiest of rationales. The federal government was never intended to have this kind of power to trample the individual.

Obamacare Repeal Petition Gaining Momentum
Virginia Tea Party Patriots Federation Petitioning US Supreme Court

(Richmond, VA) – “The Obamacare petition is gaining momentum,” said Mark Daugherty, Virginia Tea Party Patriots Federation, Chairman. “Polls show most Americans oppose Obamacare and nearly 2,000 of them signed our petition the first ten days.”

The Virginia Tea Party Patriots Federation has created an online petition asking the U.S. Supreme Court to find the Obamacare individual mandate unconstitutional and strike down the law. The goal is to collect one million signatures by May.

The Court has proved susceptible to public opinion in the past. One current sitting justice is believed to be particularly sensitive to public sentiment. Therefore, encouraging as many citizens to sign the petition as possible could potentially make a difference in the outcome of this case.

Tuesday – Health Care Rally Richmond

This Tuesday, May 10th, the 4th Circuit Court of Appeals will hear the Virginia case against ObamaCare.

Please join us in support of Attorney Gen. Ken Cuccinelli’s case against ObamaCare for a Hands off My Health Care rally. This health care bill is onerous, expensive, unconstitutional and must be overturned. This is your chance to make your voice heard and fight back against the tyranny of the federal government!

Federal judge Henry Hudson ruled in December that the requirement that every individual purchase health insurance was unconstitutional, but the U.S. Department of Justice appealed the decision. Cuccinelli had sought an expedited path to the U.S. Supreme Court, but was denied. The 4th Circuit Court will now hear the case.

The ObamaCare monstrosity is a trillion dollar boondoggle that will pile inescapable debt on America, harm health care, limit access and choices in medical services, discourage doctors from continuing in practice, raise taxes and destroy jobs. For the good of the future of this country, ObamaCare must be stopped.

Aside from the obvious harmful effects of the law, there is also an important Constitutional principle at stake! If Congress can tell you that you must purchase a product or service of any kind-there is no limit on what it can also mandate on otherwise law-abiding citizens.

The fight is far from over and we must continue to make our voices heard. Please join us as we fight for our freedom – freedom to make our own health care choices and freedom from government overreach!

Health Savings Acounts take a hit – Thanks to Jim Webb

Friends,

Happy New Year! While we’re gearing up for the new Congress and the Virginia General Assembly session, I wanted to take a minute and update you on just one of the reasons we’re fighting to repeal ObamaCare.

January 1 brought some of the first unpleasant side effects of ObamaCare to Virginia consumers – the end of Flexible Spending Accounts and Health Savings Accounts as we know them.

Desperate for tax dollars to pay for their $1 trillion health care takeover, Nancy Pelosi, Barack Obama, and Jim Webb decided to pick the pockets of consumers who opted to take responsibility for their own health care costs and remove the ability of consumers to use FSA and HSA plans to pay for things like aspirin and other non-prescription health needs.

Jim Webb cast one of the deciding votes that allowed ObamaCare to become law. See here and here.

Until this week, consumers could use their accounts to set aside pre-tax money for medical expenses. But thanks to Webb and other tax happy Democrats, over-the-counter drug purchases are now off limits to FSA and HSA accounts. Consumers who mistakenly charge such purchases to the accounts will not only be held liable for the taxes that they would have otherwise paid, but also a 20% penalty.

While we have won a major victory against this monstrosity in the courts and our new GOP majority in the House of Representatives is preparing a repeal vote in the coming days, we must continue to pursue every available opportunity to roll back this unprecedented assault on our liberty — and our nation’s fiscal future.

Cuccinelli – Individual Mandate:Unconstitutional

Dear Defender of Liberty,

Today, a federal judge in Richmond ruled the individual mandate of the federal health care law UNCONSTITUTIONAL!

In other words – we won!

This won’t be the final round, as this will ultimately be decided by the Supreme Court, but today is a critical milestone in the protection of the Constitution.

I am still fully digesting the court’s ruling, so I’ll get back to you again later with more details, but I wanted you to hear the good news right away.

Thank so many of you for your support to become the Attorney General of Virginia, and your support since then. Today is a day to celebrate those same first principles that our founding fathers articulated over 200 years ago.

We are proud to defend their work and the same first principles today in the 21st century.
